Offer Agreement

This document is mandatory for review by all visitors and users of our resource.

Registration or payment for services on the pages of the domain ethernest.pro, my.ethernest.pro, vds.ethernest.pro means complete agreement with this document and its unconditional execution.

1. Description of Services

1.1. All game servers provided to clients are public or private and operate depending on the tariff plan chosen by the client.
Full virtual access (control panel and FTP (SFTP) access) is provided to the game servers.
We use Linux operating systems, isolate game servers using Docker containers for maximum security, and modern high-performance server hardware from AMD.
The exact list of parameters is specified on the tariff plan/category page. The provision of any services is limited to what is stated in the tariff plans or service descriptions, and therefore no guarantees are provided that the services will meet your requirements or match your desires or expectations.

1.2. All additional services provided by our hosting operate according to their descriptions and are included in the general rules of the agreement.

1.3. By renting a virtual game server, the client accepts the user agreement as well as the general rules of the agreement and bears full responsibility for their actions.

1.4. Ordering a virtual game server for a period of "forever" implies the operation of the game server for the duration of this project, but for at least 20 months.

1.5. All VPS servers provided to clients are public or private and operate depending on the tariff plan chosen by the client.
A single IPv4 address is provided for VPS servers, and all other parameters and accesses are configured by the client.
We use KVM virtualization for maximum security and guaranteed resource allocation, with modern high-performance server hardware from AMD and Intel on the nodes, ensuring stable and uninterrupted operation of VPS servers.
More accurate parameters of the processor models and their operating frequencies are specified on the tariff/category page.

1.6. By renting a VPS server, the client accepts the user agreement as well as the general rules of the agreement and bears full responsibility for their actions.

1.7. VPS servers are provided with restrictions on dangerous ports, specifically ports 25, 465, 567, 587, 1900 are closed.

1.8. Activation of all services takes no more than 5 seconds after payment, but in rare exceptional cases, activation may take up to 24 hours from the moment of payment, provided that the service invoice has been successfully paid.

1.9. VDS servers do not include administration services. The Contractor is only responsible for the operational capacity of the virtual server (virtual machine), everything inside the server, including the OS, applications, and other scripts, is not related to hosting operations.

2. User Agreement

2.1. The client conducts their activities strictly on the pages of the domain ethernest.pro and the subdomains my.ethernest.pro and vds.ethernest.pro, on the special order forms, obtaining virtual funds in the billing system for further management within the platform. Accounts purchased from third parties are not subject to return or exchange. The sale/transfer of accounts or other services will result in the blocking of the sold/transferred account.

2.2. In the order form, the client independently determines all available parameters and tariff plans for the virtual game server.

2.3. After verifying the information, the client must click the "Pay Order" button and choose a payment method. The client then pays their invoice in real-time, adhering to the terms of the selected payment aggregator for their payment method. Immediately after the virtual funds are credited to the contractor's account, the virtual game server is automatically created on the client's account. All data for full virtual access, namely access to the server control panel, is sent to the client's email.

2.4. Any orders or functions related to balance top-ups or service payments are always accompanied by an invoice detailing the selected services, as well as indicating the payment period for these services (the payment period is not indicated when topping up the balance). Payment of the invoice confirms your agreement with the invoice description and its indicated services and payment period, as well as the absence of any claims against support staff, hosting administration, and hosting owners.

2.5. Full access to the virtual game server is provided for the period selected during payment. After the paid period expires, the client will be offered to pay for the extension of the order.

2.6. If the paid rental period of the Minecraft game server expires, the service will be blocked. After 21 days from the expiration of the rental period, the game server is completely removed from the system along with all related services and add-ons, with no possibility of restoring file data.

2.7. If the paid rental period of the VPS server expires, the service will be blocked. After 5 days from the expiration of the VPS rental period, the VPS server is completely removed from the system along with all related services and add-ons, with no possibility of restoring file data.

2.8. After paying their invoice, the client has the right to contact technical support for any issues directly related to the functionality of a particular service. Questions related to internal service settings (installing plugins, mods, configuring a particular plugin, parameter, configuration) are not addressed or processed by technical support.

2.9. The client has the right to install any mods, plugins, and additions to the server that do not disrupt the operation of the network, hardware, or the hosting service, or third-party resources.

2.10. Any outgoing DDoS/DOS attacks, floods, spam, brute force attempts, and other malicious scripts launched through Java available to the client are prohibited. The server will be blocked without the possibility of unblocking and with complete removal of the service.

2.11. The client may change the launch string for the game server, make additional parameters, points, edits, and other necessary changes exclusively through a request to support. All necessary adjustments will be made after support verification, if they are indeed necessary and will not disrupt the server and hosting operation. Changing the launch string by any other means is prohibited, and will result in blocking the server's operation, with the possibility of unblocking once.

2.12. VPS servers may be blocked for suspicion of rule violations, as well as in cases of registration from anonymous networks, using PROXY, VPN, TOR, and other anonymization tools. Restrictions also apply to suspicious names in languages other than those of CIS countries, invalid phone numbers, “disposable” email addresses, and temporary emails. If such a violation is detected, the client will need to undergo identity verification by providing necessary documents and confirmation. In case of refusal, the account will be blocked and all services removed. We oppose black and gray schemes on the internet.

2.13. Violating the laws of any country is "irreversible"; upon the first official request regarding a violation with confirmation from blacklists and other internet providers that have suffered damage, we will delete the VPS/game server.

2.14. When choosing the payment method Fondy (subscription) or Stripe, the client agrees that all invoices designated for these payment methods will be automatically paid from their credit cards that were added by the client to the billing panel. In case of insufficient funds, repeated payment attempts will be made within two weeks. To remove a card from the profile, a request must be sent to support.

2.15. From the moment the service is stopped due to overdue payment, the service does not belong to the user who purchased it. They have no access to its management, files, or other parameters. Access to the service is restored after paying for the suspended service in full for the entire period indicated in the invoice.

2.16. Overdue invoices are not subject to correction, change, or adjustment of the payment period for the service. Payment of the issued invoice after the service period has expired is not grounds for extending the service period beyond what is indicated in the invoice or changing the service duration beyond what is specified in the invoice.

2.17. All additional services, including free ones (provided on a gratuitous basis), are not related to the main service they are provided with, are not subject to any discussions or support requests, and are provided without obligations, which does not guarantee satisfaction of your desires or needs.

2.18. It is prohibited to use MySQL databases for plugins like bluemap, dynmap, and similar. One database must not exceed 5 GB of data. The database may be deleted without prior notice if the MySQL database usage is violated or the size is exceeded. Databases with useful information, such as coreprotect or important data for the server's functionality, are exceptions and may be up to 10 GB per database.

2.19. When changing additional parameters/resources of the server, there is no refund to the balance, and there is also no return of parameters or tariff to the previous value without re-payment.

2.20. The client is fully responsible for the losses incurred by the Contractor, related both to additional expenses for disputing transactions and other possible expenses/commissions not related to the actions of the Contractor. Charges may be in the form of deductions from the credit balance, days of rent for existing services, and service suspension. The Contractor reserves the right to suspend all services without the right to refund or access to files until the debt is settled by the Client.

3. Legislative Agreement

3.1. This agreement is a public offer addressed to an unlimited number of persons. Full and unconditional acceptance (acceptance) of the terms of this public offer is considered the commencement of use of test services or the client's payment for the services of the contractor and receiving the corresponding email at the specified email address confirming the payment.

3.2. All disputes arising between the parties in connection with the performance of this agreement are resolved through negotiations. If resolving disputes and disagreements based on mutual agreements is impossible, they are subject to resolution in the manner established by applicable law.

Technical support operates daily from 8:00 AM to midnight on weekdays and from 9:00 AM to 11:00 PM on weekends. The average response time is up to 1 hour, but delays may occur due to staff workload. Responses during nighttime hours are provided based on technical availability.

5. Acceptable Load and Service Use

5.1. Each game server has a load limit on computing resources – CPU (%), RAM (%), and disk space. Game servers of certain tariff plans have limitations specified in the tariff plan description or elsewhere on the tariff plan page. The acceptable load value is distributed across the tariffs.

5.2. The client has the right to choose which tariff suits them best, but must comply with acceptable load norms for the core (p.p. 5.1).

5.3. All issues related to increased load are resolved through support by negotiating between the contractor and the client. The client's service may be suspended during negotiations regarding exceeding the acceptable load limit on the equipment.

5.4. It is prohibited to run any software on the site that generates malicious traffic, stress-test traffic, or software for mining any cryptocurrency. We reserve the right to block all user services without prior notice, without the right to a refund and unblocking.

5.5. Outgoing DDoS/DOS attacks, flood attacks, and any form of flooding, spam attacks on email services, and any possible services vulnerable to spam attacks, as well as any "brute force" attacks aimed at password guessing, are prohibited. Scanning ports for any purposes, scanning proxy servers regardless of their purposes, participation in botnets in any form, and any actions aimed at causing moral, physical, material, psychological, or any other harm to anyone are prohibited.

5.6. We reserve the full right to block services after receiving a complaint from the rights holder about violations related to the distribution or storage of copyrighted content/materials, warning the user at our discretion.

6. Refusal of Service

6.1. If changes are made to the configuration of the purchased service by exploiting vulnerabilities (bugs, shortcomings) in the software, the service will be blocked, and negotiations between the contractor and the client will be conducted in accordance with paragraph 3.2 to resolve the issue.

6.2. The company reserves the right to refuse the client service due to the client's violation of the agreement.

6.3. The company reserves the right to refuse the client service at its discretion without prior notice or explanation of reasons.

7. Referral Program

7.1. Every user has the right to participate in the referral program after registering on the site my.ethernest.pro (hereinafter referred to as the partner).

7.2. Any user attracted through a referral link becomes a referral of the partner who brought them to the site.

7.3. After making a purchase on the site, any of the services, after a 30-day period from the date of purchase, the partner will receive a 10% commission to their referral program balance.

7.4. The minimum amount to create a payout request for earned funds is $10 at the current exchange rate on the site my.ethernest.pro.

7.5. Payout requests are processed within up to 7 working days.

7.6. Payments are made to Visa/Mastercard bank cards. Payments in $ currency are not available.

7.7. When specifying "dollar" as the currency in the profile, the average exchange rate over the entire period for which the request is created is taken into account, not the one indicated at the time of the request creation.

7.8. Any manipulations related to the partner program aimed at deceiving the billing are considered a violation of the rules. Creating multiple accounts is prohibited, as is registering via one’s own referral link. Registrations, transitions, and payments that violate the rules will not be compensated.

Information on Conducting, Payment Procedure, and Rules

Payments are accepted via the following cards: VISA, MasterCard, Maestro. To pay for the service with a bank card during the checkout process in the online store, select the payment method: bank card. When paying for an order with a bank card, the payment processing occurs on the bank's authorization page, where you need to enter your bank card details:

If your card is connected to the 3D-Secure service, you will be automatically redirected to the page of the bank that issued the card for the authentication procedure. For information on the rules and methods of additional identification, please consult the bank that issued your bank card.

Return Policy

1. In case of refusal of the provided rental service of a virtual game server, the refund of unused virtual funds is only possible in the presence of a technical malfunction (more than 120 hours per calendar month, from the moment of the malfunction report) of the service the client refuses to use. All internal settings of the service performed by the client are not considered technical parts. All tariffs are fully transparent, and all information is indicated before registration.

2. Payments are made only to the same payment details that match the payer's details for that account.

The refund of unused funds is processed through a client's request submitted via billing to technical support, after which the request is reviewed by the administration within up to 7 working days, and a decision regarding the payment of funds is made. Refunds are only possible to the bank account that matches the full name of the client on the site, or to the payment details used for the payment.

4. Refunds for already provided rental game server services are not made, with a minimum service provision period of 30 days. This also applies to the "Eternal" server service, for which refunds are completely impossible.

5. The administration reserves the right to refuse the refund of funds for non-objective reasons from the client (see paragraph 1). Non-objective reasons include issues related to the client's personal problems, lack of skills in managing the service, lack of time, or inability to predict the desired tariff plan for their goals.

6. Refunds of unused funds from the personal account (credit balance) are not made.

7. Refunds are also not made if the client has used the service quality testing, which provides a completely free test server for up to 24 hours. By receiving a service on a paid tariff after the free testing, the client confirms that they have no complaints about the quality of work and execution, and a refund will be impossible.
